Please read these terms and conditions carefully before using our immigration and work permit services in Malaysia.

Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Client”, “you”, or “your”) and Agensi Pekerjaan ENM Sdn. Bhd. (“ENM”, “we”, “our”, or “us”) regarding your use of our website and services.

By accessing our website at enm.my or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, please do not use our services.

ENM provides professional immigration and employment services including:

Work Permit Application Services

  • Document compilation and printing
  • Employment contract stamping
  • Government application form assistance
  • Application submission to JKM and JIM
  • Ongoing follow-up with government authorities
  • Visa processing and passport endorsement
  • Consulting and advisory services

Manpower Recruitment Services

  • Candidate sourcing and screening
  • Pre-qualification and short-listing
  • Interview coordination
  • Medical examination facilitation
  • POEA/OWWA requirements processing
  • OFW compulsory insurance enrollment
  • Pre-employment and pre-departure orientation
  • Travel arrangements

Professional Accreditation

ENM is accredited by the Philippines Overseas Labor Office (POLO) Malaysia and operates in compliance with Malaysian immigration laws and regulations.

Client Responsibilities and Obligations

By engaging our services, you agree to:

Documentation and Information

  • Provide accurate, complete, and truthful information
  • Submit all required documents in a timely manner
  • Ensure all documents are genuine and legally obtained
  • Notify us immediately of any changes to provided information
  • Cooperate fully with government authorities during the application process

Legal Compliance

  • Comply with all Malaysian immigration laws and regulations
  • Respect the terms and conditions of any issued work permits or visas
  • Maintain legal status throughout the employment period
  • Report any legal issues that may affect immigration status

Payment Terms

  • Pay all fees as agreed in the service contract
  • Make payments according to the specified payment schedule
  • Cover all government fees, medical examination costs, and third-party charges
  • Understand that certain fees are non-refundable once services commence
Service Limitations and Disclaimers

Important Notice

While ENM provides professional assistance, we cannot guarantee approval of any government applications. Final decisions rest with the relevant authorities.

What We Do NOT Guarantee

  • Approval of work permit or visa applications
  • Specific processing timelines by government authorities
  • Exemption from government policy changes
  • Protection against application rejection due to regulatory changes
  • Continued validity of permits under changing immigration policies

Government Authority

All work permit and visa approvals are subject to the discretion of Malaysian government authorities including JKM, JIM, and other relevant agencies. ENM acts as a professional intermediary and cannot influence government decisions.

Third-Party Services

Some services may involve third parties (medical centers, courier services, government agencies). ENM is not responsible for delays or issues arising from third-party service providers beyond our control.

Intellectual Property Rights

Our Content

All content on our website, including text, images, logos, trademarks, and service marks, is owned by ENM or used with permission. You may not reproduce, distribute, or use our content without written permission.

Your Content

Documents and information you provide remain your property. However, by submitting information to us, you grant ENM permission to use this information for the purpose of providing our services, including submission to government authorities.

Confidentiality

ENM maintains strict confidentiality of client information in accordance with professional standards and Malaysian data protection laws. We will not disclose your information except as necessary to provide services or as required by law.

Limitation of Liability

Service Limitations

ENM’s liability is limited to the fees paid for our professional services. We are not liable for:

  • Government decisions on permit or visa applications
  • Changes in immigration policies or regulations
  • Delays caused by government processing times
  • Third-party service provider issues
  • Consequential or indirect damages
  • Lost opportunities or business interruption

Force Majeure

ENM is not responsible for delays or failures in service delivery due to circumstances beyond our control, including natural disasters, government actions, pandemics, or changes in law.

Maximum Liability

In no event shall ENM’s total liability exceed the amount of fees paid by the client for the specific service in question.

Service Termination

Termination by Client

You may terminate our services at any time by providing written notice. However, fees for work already completed and government fees paid are non-refundable.

Termination by ENM

ENM may terminate services if:

  • Client provides false or misleading information
  • Client fails to pay agreed fees
  • Client fails to provide required documentation
  • Service continuation would violate applicable laws
  • Client engages in behavior that compromises our professional standing

Effects of Termination

Upon termination, ENM will provide all original documents and completed work. Confidentiality obligations continue after termination. Outstanding fees remain payable.

Governing Law and Dispute Resolution

Applicable Law

These Terms are governed by the laws of Malaysia. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of Malaysian courts in Sabah.

Dispute Resolution

We encourage resolving disputes through direct communication. If formal dispute resolution is necessary:

  • Attempts should first be made to resolve disputes through negotiation
  • Mediation may be pursued before formal legal proceedings
  • Legal proceedings shall be conducted in English or Bahasa Malaysia
  • Venue for legal proceedings shall be in Kota Kinabalu, Sabah

Professional Standards

ENM operates under professional standards and may be subject to oversight by relevant professional bodies and government agencies regulating immigration services in Malaysia.

Changes to These Terms

ENM reserves the right to modify these Terms at any time. Changes will be effective when posted on our website. We will notify clients of material changes by:

  • Updating the “Last updated” date on this page
  • Email notification to active clients
  • Notice on our website

Continued use of our services after changes constitutes acceptance of the revised Terms.
